HR Handbook Policies That Reflect Best Practices

The following handbook policies reflect HR best practices and/or regulatory changes that the HR professionals have modified. You may wish to update your own handbook policies based on the information below, or reach out to the HR Professionals to request that an updated policy be sent to you. State: SC

Policy: Family and Medical Leave 

Here's what we've done:

This is a new policy that covers a 2002 law, which allows employees to take unpaid time off of work to isolate or quarantine when ordered to do so by the Department of Health and Environmental Control during a public health emergency. We recommend employers add this policy to their handbooks as soon as possible and ensure that managers are made aware of it in the meantime.

 

State: CA

Policy: State Disability Insurance

Here's what we've done:

This policy has been updated to include "a qualifying exigency related to a family member in the military" as a reason for receiving paid family leave. Employers have an obligation to provide the Paid Family Leave brochure when they believe an employee may be entitled to this leave for any qualifying reason. We recommend making this minor update to improve the likelihood of compliance with that requirement.

 

State: CA

Policy: Family and Medical Leave

Here's what we've done:

This policy, which as of January 1 will apply to employers with five or more employees, has been updated to reflect the other expansions to the California Family Rights Act that take effect in 2021. We recommend updating your handbook by January 1.

 

State: CA

Policy: Domestic Violence & Sexual Assault Leave

Here's what we've done:

The policy formerly known as Victims of Domestic Violence, Sexual Assault, and Stalking, has been rewritten and renamed, to reflect that California has essentially consolidated its crime victim and domestic violence victim leave laws and broadened their protections. This new singular policy should replace Crime Victim Leave and Leave for Victims of Domestic Violence, Sexual Assault, and Stalking. We recommend updating your handbook by January 1 when the law takes effect.

 

State: NV

Policy: Small Necessities Leave

Here's what we've done:

This is a new policy, which applies to employers with 50 or more employees working in Nevada, and covers the state's earned paid leave law that took effect in 2020. We recommend employers that do not already have this policy add it to their handbook during their next update.

 

State: ME

Policy: Small Necessities Leave

Here's what we've done:

This is a new policy, which applies to employers with 11 or more employees in Maine, and covers the new Earned Paid Leave law that takes effect in 2021. We recommend employers add this policy to their handbook by January 1 and ensure that managers are familiar with it.

Policy: Family Medical Leave

Here's what we've done:

This policy has been updated to include a section on Maine's Extreme Public Health Emergency Leave. We recommend employers update this policy as soon as possible and ensure that all employees are aware of this leave in the meantime.

 

State: NY

Policy: Sick Leave - Accrual

Here's what we've done:

This is a new policy that applies to employers of all sizes and covers New York's sick leave law (requirements vary by employer size). Employees began to accrue leave under the law on September 30th and may begin using their leave at the start of the new year. We recommend adding this policy to your handbook by January 1.

 

State: OR

Policy: Sick Leave - Accrual

Here's what we've done:

This policy, which applies to employers of all sizes (though pay is not required for very small employers), has been updated to include a more comprehensive list of reasons why an employee can take sick leave, including for baby bonding and when their workplace or child's place of care is closed due to a public health emergency. We recommend employers update this policy as soon as possible and make sure that all employees are aware of their rights in the meantime.

 

State: CO

Policy: Sick Leave - Accrual

Here's what we've done:

This is a new policy that applies to all employers with 16 or more employees (regardless of location) and covers Colorado's sick leave law, which takes effect in the new year. Employers should add this policy to their handbook by January 1 and ensure that managers are familiar with it.

 

State: MD

Policy: Sick Leave - Accrual

Here's what we've done:

We have added a section to the sick leave policy to cover Maryland's Catastrophic Health Emergency Leave. This new policy section covers a 2015 law, which allows employees to take unpaid time off of work to isolate or quarantine during a public health emergency if ordered to do so by the Secretary of the Maryland Department of Health. We recommend employers add this policy to their handbooks as soon as possible and ensure that managers are made aware of it in the meantime.

 

State: IA

This is a new policy that covers a 2003 law, which allows employees to take unpaid time off of work to isolate or quarantine during a public health disaster. We recommend employers add this policy to their handbooks as soon as possible and ensure that managers are made aware of it in the meantime.

This is a new policy that covers a 2005 law, which allows employees to take unpaid time off of work to isolate or quarantine during a public health emergency or to care for certain family members in isolation or quarantine. We recommend employers add it to their handbooks as soon as possible and ensure that managers are made aware of it in the meantime

 

State: NJ

Policy: Sick Leave - Accrual

Here's what we've done:

We have added a section to the sick leave policy to cover New Jersey's Public Health Emergency Leave (PHEL) law. This new section covers a 2005 law, which allows employees to take unpaid time off of work to isolate or quarantine during a public health emergency if ordered to do so by the Commissioner of the Department of Health. We recommend employers add this to their handbooks as soon as possible and ensure that managers are made aware of it in the meantime.

 

State: NM
